Your website and Kenya's data law

Data Protection Act, 2019, enforced by the Office of the Data Protection Commissioner (ODPC). What it means for a small website:

  • Register with the ODPC unless your business has both a turnover below KES 5 million and fewer than 10 staff. Some sectors, such as health, education, hospitality and finance, must register whatever their size.
  • Registration for a small business costs KES 4,000 and is valid for 24 months.
  • If personal data leaks, tell the ODPC within 72 hours.
  • Storing data outside Kenya is allowed when appropriate safeguards are in place, for example a written agreement with your host.

Can I get a .co.ke domain with my hosting?

Yes. A .co.ke domain is free with yearly billing on TPC Business and Premium, for as long as your hosting renews. TPC Standard includes a free .com instead. On its own a .co.ke costs €29.99 for the first year and €34.99 after that.
