Throughout this document, “TPC Hosting,” “we,” “us,” and “our” refer to TPC Management s.r.l. “Customer,” “you,” and “your” refer to the individual or entity purchasing or using our services.


2. Scope and Acceptance

These Terms and Conditions govern all services offered through the TPC Hosting website and apply to every contractual relationship between TPC Hosting and its customers.

Our services are primarily designed for businesses, legal entities, and institutions with the legal capacity to enter into contracts. For this reason, all prices on the website are displayed excluding VAT. Individuals may also purchase services; the applicable VAT is calculated and displayed during checkout before the order is finalised.

Any external links referenced in this document (such as service descriptions, policies, or technical specifications) form an integral part of these Terms and Conditions.

Any supplementary agreements or modifications to these terms require the written consent of both parties.

The version of these Terms and Conditions in effect at the time you place your order is the version that governs your contract with us.

The services covered by your contract are those listed on tpc-hosting.com at the time of your order.


3. Contract Formation

By placing an order, you accept these Terms and Conditions and initiate a contractual relationship with TPC Hosting.

We will send an order confirmation promptly. This confirmation acknowledges receipt of your order but does not oblige either party to proceed with activation.

We reserve the right to accept or decline any order within one (1) business day. Orders may be declined if we have reasonable concerns about authenticity or trustworthiness.

Order risk assessment. TPC Hosting performs automated and manual risk assessments on all incoming orders to protect the integrity of our platform and prevent abuse. These assessments may consider factors including but not limited to:

  • Mismatched or incomplete billing and contact details
  • Use of disposable email addresses, VPN or proxy connections, or anonymisation tools
  • Matches against known fraud databases or abuse records
  • Order patterns such as bulk orders, rapid account creation, or unusual purchasing behaviour
  • Previous abuse history associated with the customer, payment method, or IP address
  • High-risk geographic indicators
  • The nature of the intended use or content type

TPC Hosting is not required to disclose the specific reasons for declining an order. If your order is declined, you will be notified and may contact us for further information.

Orders flagged as high-risk but not declined may be subject to additional identity verification under Section 4.


4. Identity Verification (KYC)

TPC Hosting implements Know Your Customer (KYC) procedures to prevent fraud, ensure compliance with applicable regulations, and maintain the security and integrity of our platform.

When verification may be required. TPC Hosting may request identity verification at any time, including but not limited to:

  • During account registration or first order
  • When an order is flagged as high-risk by our risk assessment process (see Section 3)
  • When requesting sensitive account changes (e.g., ownership transfers, contact detail updates)
  • When required by law or by our payment processors
  • When there are reasonable grounds to suspect fraudulent or unauthorised activity
  • During periodic reviews of active accounts as part of ongoing risk monitoring

What we may request. Depending on the circumstances, you may be asked to provide:

  • A valid government-issued photo ID (passport, national ID card, or driving licence)
  • Proof of address (utility bill, bank statement, or official correspondence dated within the last 3 months)
  • Business registration documents (for legal entities)
  • A selfie or live photo for identity matching
  • Additional documentation as reasonably required

Processing. All documents submitted for KYC purposes are handled in accordance with our Privacy Policy and applicable data protection laws. Documents are used solely for verification purposes and are retained only as long as necessary to fulfil that purpose or as required by law.

Non-compliance. If you fail to provide the requested documentation within the timeframe specified (typically 7 days), TPC Hosting reserves the right to:

  • Delay or cancel order activation
  • Suspend active services
  • Terminate the account

TPC Hosting will notify you before taking any such action and provide a reasonable opportunity to comply.


5. Pricing and Payment

Displayed prices. All prices on the TPC Hosting website are shown excluding VAT. VAT is calculated and displayed at checkout.

Billing periods. Billing cycles vary by service. The applicable billing period is shown during the order process and on your invoice.

Advance payment. All services must be paid for in advance of the period in which they are provided.

Currency. Regardless of the currency used to display prices, all invoices and payments are processed in RON (Romanian Leu) at the National Bank of Romania (BNR) exchange rate on the date of invoicing, in accordance with Romanian law.

Invoice delivery. All invoices are issued and delivered electronically — by email and through your customer account. TPC Hosting does not issue paper invoices.

Automatic renewal invoicing. Renewal invoices are generated and sent automatically 7 days before the start of each new billing period. If you do not wish to renew a service, you must cancel it before the renewal invoice is issued. Once an invoice has been issued, the corresponding billing period is due for payment.

Contract term and auto-renewal. The minimum contract term for each service equals the billing cycle selected at the time of purchase (e.g., a 12-month billing cycle constitutes a 12-month commitment). At the end of each billing cycle, services renew automatically for the same period at the then-current price, unless cancelled before the renewal invoice is issued.

Cancellation. You may cancel any service at any time through your customer account dashboard or by submitting a support ticket. Cancellation takes effect at the end of the current billing period — your service remains active until then. Prepaid fees for the remaining billing period are not refundable (see Section 9). You are responsible for exporting or backing up your data before the service expires.

Tax invoices are issued only after payment has been received and credited to a TPC Hosting bank account. Tax invoices are issued during business hours, excluding public holidays.


6. Service Activation

All services are activated after payment is received.

  • Credit/debit card payments: Services are activated within 2 hours of payment.
  • Bank transfer payments: Services are activated once the full invoiced amount is received. This may take one to several business days depending on transfer times, public holidays, and currencies involved. You will receive a notification when payment is confirmed.

All activation details, login credentials, and account information are sent to the email address on file.


7. Late Payment, Suspension, and Reactivation

Grace period. TPC Hosting’s own hosting services remain active for up to 7 days past the invoice due date. Third-party services (domains, licences, SSL certificates) cannot be extended past their expiration date and require timely payment.

Deferred payment. You may request a payment deferral at any time by contacting us before the due date.

Automatic suspension. If payment is not received within 7 days of the due date — and no proof of payment or deferral request has been submitted — your account will be automatically suspended.

Reactivation. Suspended accounts are reactivated only after full payment of all outstanding amounts. Proof of payment triggers reactivation of services; the tax invoice is issued once funds are visible in our bank account.

Account deletion. If non-payment exceeds 30 days — whether due to unpaid invoices or service cancellation — your account and all associated data will be permanently deleted from our servers. If you cancel a service, you are responsible for exporting or backing up your data before the end of the current billing period.

Data recovery. If a backup still exists at the time of deletion, data restoration may be requested for a fee of €25.00. TPC Hosting does not guarantee that backups will be available after account deletion.


8. Upgrades and Downgrades

You may upgrade or downgrade your services at any time.

  • Upgrades: You pay only the price difference between your current plan and the new plan, prorated for the remaining prepaid period.
  • Downgrades: Any remaining credit is applied to extend the service at the new rate. We recommend consulting our team before downgrading to ensure the new plan meets your needs.

Restrictions:

  • Downgrades that require migration and reconfiguration are limited to once every 30 days.
  • TPC Hosting may charge a one-time administration fee for plan changes (upgrades, downgrades, or offer switches). This fee will be communicated to you before the change is made.
  • Services with a price range (“from – to”) are listed at the minimum rate. Selecting higher-tier options incurs additional charges.

9. Refund Policy

You may request a full refund within 30 calendar days of service activation — no questions asked.

After 30 calendar days, no refund is available. You may cancel your service at any time, but prepaid fees for the remaining billing period are not refundable.

Deductions. If your order included complimentary services (such as a free domain, licence, or SSL certificate), their retail value will be deducted from the refund.

Non-refundable services. The following are non-refundable once provisioned:

  • Domain registrations and renewals
  • Software licences
  • SSL certificates
  • Other third-party services procured on your behalf

Forfeiture. TPC Hosting reserves the right to withhold refunds if you have violated these Terms and Conditions.


10. Promotions and Coupons

Promotional Offers

Free products or services included in a promotional offer may only be used on TPC Hosting’s infrastructure. If you transfer services to another provider, the retail value of those complimentary items will be deducted from any credit or refund.

TPC Hosting may withdraw any promotional offer at any time without prior notice.

Unless stated otherwise, complimentary services are free for the first year only. Standard pricing applies upon renewal. TPC Hosting may extend the free period at its discretion.

Coupon Types

Type Description
Weekly Each week, a randomly selected hosting package receives a discount coupon. Discount amounts and minimum purchase periods vary.
Flash Valid for 24 hours only, with higher discount percentages.
Monthly Available all month on all hosting packages. Discount is based on the billing period, not the package.
Holiday Issued during selected holidays, covering the full range of hosting services.
Limited Not time-restricted, but limited by the number of uses. Once exhausted, the coupon is permanently expired.

Coupon Conditions

  • Available to all individuals and legal entities
  • Apply only to new hosting orders (not renewals or upgrades)
  • Apply only to the first billing period
  • Apply only to TPC Hosting hosting packages
  • Cannot be applied retroactively
  • Cannot be combined with other coupons or discounts
  • Do not affect complimentary services included in a package
  • The hosted website must comply with these Terms and Conditions

11. Domain Registration

TPC Hosting acts as an intermediary for domain name registration and renewal. Our responsibility is limited to facilitating the registration or renewal process.

Availability. We verify only that a domain is available for registration. We do not check whether a domain name infringes any laws, trademarks, or third-party intellectual property rights. That responsibility lies entirely with you.

Ownership and registrant data. Unless you provide separate registrant data through the order form or in writing, domains are registered using the identification data in your customer account. You become the legal owner of, and legally responsible for, all domains registered under your account.

Registrant data accuracy (ICANN / registry requirement). You are required to provide accurate, complete, and up-to-date registrant contact information (name, address, email, phone number) at the time of registration and to keep it current throughout the life of the domain. This obligation applies under ICANN’s Registrant Rights and Responsibilities and the policies of the applicable domain registry. Providing false or outdated registrant data may result in:

  • Suspension or cancellation of the domain by the registrar or registry
  • Loss of the domain in a dispute proceeding (e.g., UDRP)
  • TPC Hosting suspending the domain or associated hosting services

TPC Hosting may request updated registrant documentation at any time and may verify registrant identity in accordance with our KYC procedures (Section 4). Failure to provide accurate data within the requested timeframe may result in service suspension.

No guarantees. TPC Hosting does not guarantee successful registration or renewal. Domain extensions are managed by independent registries, each with its own terms, policies, and dispute procedures.

Documentation. You must provide all information and documents requested by TPC Hosting and follow our instructions to ensure successful registration or renewal. Extension-specific requirements are available on our domain terms page.

Timely renewal. We strongly recommend paying domain renewal invoices before the due date to avoid losing the domain. If a domain is paid after its expiration date, TPC Hosting is not responsible for any additional registrar fees for reactivation or late renewal.

Availability risk. TPC Hosting is not responsible for domain name availability between the time an order is placed and the time payment is received.


12. Limitation of Liability

Service interruptions. TPC Hosting is not liable for damages caused by temporary unavailability of equipment or network, regardless of the cause. This includes any loss of data.

Indemnification. You agree to indemnify, defend, and hold TPC Hosting harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services or any violation of these Terms and Conditions.

Our liability. TPC Hosting accepts liability only where a service interruption was caused intentionally or through negligence by our team. In all cases, our total liability is limited to the amount you paid on your most recent invoice for the affected service. Service credits issued under the SLA (Section 16) are included within — not in addition to — this liability cap.

Your liability. You are responsible for any damage caused to TPC Hosting — directly or indirectly — through misuse of services or violation of these terms, including legal fees, attorney’s fees, and any other related expenses.

Knowledge base and tutorials. TPC Hosting publishes tutorials, configuration guides, and informational articles on its website. All such content was tested and verified at the time of publication using the software versions and configurations available at that time. We do not guarantee that these instructions will produce the desired results on different configurations or later software versions, and we accept no liability for damages arising from their application.


13. Data Security and Backups

Server security. For shared hosting and managed servers, TPC Hosting is responsible for server-level security but not for the security of applications installed by the customer.

Application security. TPC Hosting accepts no responsibility for security vulnerabilities in customer-installed applications or any resulting damage. Application security is the responsibility of the application administrator and developer.

Device security. You are responsible for securing any personal devices used to access your hosting account. Ensure that your devices and installed applications are kept up to date.

Access credentials. Your accounts are protected by usernames, passwords, or digital certificates. You are solely responsible for keeping these credentials secure. If you suspect that an unauthorised third party has gained access to your credentials, reset them immediately. If you are unable to do so, contact us via a support ticket.

Backups. TPC Hosting performs routine backups as described on our backup policy page. However, we do not guarantee the integrity or availability of any backup. You are solely responsible for maintaining your own backups.

Backup restoration. For managed services (shared hosting and managed VPS), backup restoration requests are fulfilled within 24 hours during business days. Restoration is subject to backup availability and does not override the customer’s responsibility to maintain independent backups.


14. Support and Assistance

All TPC Hosting customers receive support through the channels and during the hours listed on our contact page.

Response times vary depending on the complexity of the issue and current support volume. Email response times are typically under 60 minutes but may be longer during peak periods.

Phone and live-chat support provides real-time communication but does not guarantee immediate resolution. Phone calls exceeding 10–15 minutes may be redirected to email or ticket-based support for more effective resolution.

Data Migration

Migration to or between TPC Hosting managed servers is provided free of charge and completed within 48 business hours of receiving all required access credentials and data. This timeframe may extend for unusually large datasets; in such cases, TPC Hosting will communicate an estimated completion time.

If a migration must be repeated due to actions (or inactions) on your part — contrary to the instructions provided — TPC Hosting may decline to repeat it or charge a migration fee of €10.00.

Scope of Support

TPC Hosting support covers the operation of our hosting services. The following tasks are outside our standard support scope unless explicitly stated otherwise:

  • Installing or configuring third-party applications
  • Installing or configuring external devices
  • Updating third-party applications
  • Application optimization and security hardening

We will assist with these tasks on a best-effort basis, within the limits of our team’s availability and expertise.


15. Service Tiers and Responsibilities

TPC Hosting offers three service tiers: Shared Hosting, Managed VPS, and Self-Managed VPS. The table below summarises who is responsible for each area of server and application management.

Shared Hosting

Shared hosting is a fully managed service. TPC Hosting is responsible for all server-level infrastructure, including the operating system, web server, database server, mail server, control panel, FTP server, programming language runtimes, firewall, and security patches.

You are responsible for your own applications, content, and data. Application installation, updates, and security hardening are your responsibility.

Shared server limitations. On shared servers, TPC Hosting may decline changes that would affect all customers on the server (e.g., web server, FTP, email, or database engine changes). Where possible, we will recommend a VPS as an alternative.

Managed VPS

The administration included with managed VPS plans covers core server services: web server, mail server, database server, control panel, FTP server, and standard programming language runtimes. This includes installation, configuration, updating, and ongoing monitoring of these core services to maintain reliable operation.

Root access. Managed VPS customers receive root/admin access to their server. However, if customer modifications to server configuration cause issues, TPC Hosting’s managed service guarantee is voided for those changes. Remediation of customer-caused issues is billed at €15.00/hour (minimum one hour).

Firewall. TPC Hosting configures and maintains default firewall rules. Custom firewall rules may be requested through support.

Additional services. Requests for services or applications outside the core scope are treated as paid work and billed at €15.00/hour (minimum one hour). This rate also applies to any subsequent work on those services.

Administration scope. Support is limited to services and technologies in which our team has operational experience.

Self-Managed VPS

If you choose a self-managed VPS, you are fully responsible for all aspects of server administration and security. TPC Hosting does not provide technical support for self-managed servers.

Self-managed VPS servers are connected directly to the internet with a public IP address and no restrictions. We strongly recommend implementing a firewall, disabling root login, using non-standard usernames, and authenticating with SSH certificates.

Switching to managed. TPC Hosting can take over administration of a self-managed VPS for a monthly fee of €25.00. Existing non-standard services will be assessed separately and billed at €15.00/hour (minimum one hour). Because managed VPS servers include performance optimizations and automated tasks, a transition to managed service requires provisioning a fresh VPS — you will need to migrate your data to the new server.

General Provisions

Software installation. Installation of additional software or libraries on shared or VPS environments requires prior analysis and approval by TPC Hosting. We reserve the right to decline installations that pose a risk to server stability or security.

Operating system end-of-life. TPC Hosting monitors OS lifecycle status and will notify managed VPS customers at least 90 days before their server’s operating system reaches end-of-life. Migration to a supported OS version is the customer’s responsibility — the customer must initiate the request. TPC Hosting will perform the migration as part of the managed service scope at no additional charge, but will not act without a customer request. If the customer does not migrate before end-of-life, TPC Hosting reserves the right to limit the support scope on unsupported OS versions.

Support termination. TPC Hosting reserves the right to discontinue support in cases of:

  • Repeated or excessive administration requests beyond the scope of the plan
  • Abusive, threatening, or otherwise inappropriate behaviour toward TPC Hosting staff

16. Service Level Agreement (SLA)

Uptime commitment. TPC Hosting guarantees 99.9% monthly uptime for all hosting services (shared hosting, managed VPS, and self-managed VPS infrastructure).

Monthly uptime is calculated as: ((total minutes in month − downtime minutes) / total minutes in month) × 100

Exclusions. The following are not counted as downtime for SLA purposes:

  • Announced maintenance windows
  • Force majeure events (Section 28)
  • Downtime caused by customer actions, including misconfigurations, application errors, or resource exhaustion caused by customer software
  • Downtime of third-party services not operated by TPC Hosting

Service credits. If monthly uptime falls below 99.9%, you are entitled to a pro-rated credit for the actual downtime exceeding the SLA threshold. Credits are calculated as a proportion of the monthly fee for the affected service corresponding to the excess downtime.

Credits are applied to your next invoice. To receive a credit, you must submit a request within 30 days of the incident via our contact page.

Credit cap. Total credits in any billing period shall not exceed 100% of one month’s fee for the affected service. Service credits are your sole and exclusive remedy for SLA breaches.


17. Incident Response

This section applies to managed services only (shared hosting and managed VPS). Self-managed VPS customers are responsible for their own incident detection and response.

Response times. TPC Hosting commits to the following response times for managed service incidents:

Response vs. resolution. Response time refers to the time between your report and our first meaningful acknowledgement or diagnostic action. Resolution times depend on the nature and complexity of the incident and are not guaranteed.

Reporting. To ensure the fastest response, report incidents through the support channels listed on our contact page. Include the email address associated with your TPC Hosting account, a description of the issue, affected services, and any error messages or symptoms observed. We may require identity verification before acting on the request.


18. Reseller and VPS Resale

You may establish your own hosting relationships with third parties using TPC Hosting’s infrastructure. In such cases, you remain TPC Hosting’s sole contractual partner.

Notification requirement. You must notify TPC Hosting in writing before reselling or redistributing any services to third parties. TPC Hosting reserves the right to decline resale arrangements or impose additional conditions. Reselling without prior notification is a violation of these Terms and Conditions and may result in immediate suspension of your account.

Your obligations:

  • You must communicate these Terms and Conditions to your own customers and ensure their compliance.
  • You must verify the identity and contact details of your own customers before provisioning services to them. You are responsible for ensuring that your customers do not use TPC Hosting infrastructure for phishing, spam, fraud, or any other prohibited activity (see Section 19, Section 22).
  • You must maintain an up-to-date register of your customers and their associated services, and provide this information to TPC Hosting within 24 hours upon request.
  • You must cooperate with TPC Hosting if changes need to be made to your customers’ accounts, including providing their contact details upon request.
  • TPC Hosting may contact your customers directly and request written confirmation for account changes.

Abuse by end customers. If an end customer engages in prohibited activity (including but not limited to phishing, spam, or distribution of malware), TPC Hosting may suspend the affected services immediately without prior notice. If repeated abuse incidents occur under your reseller account, TPC Hosting reserves the right to suspend or terminate your entire account.

Your liability. You are fully responsible — including financially — for any violations of these Terms and Conditions committed by your customers. You agree to indemnify TPC Hosting against all claims arising from the actions of your customers or other third parties.


19. Content Policy

TPC Hosting services may be used to host, deploy, and operate applications for both personal and commercial purposes.

You are responsible for ensuring that all content you host complies with applicable laws and respects the intellectual property rights of third parties.

Prohibited content. You may not use TPC Hosting services to store, distribute, or link to any of the following:

  • Content that infringes copyright, trademarks, or other intellectual property rights
  • Pornography or sexually explicit material that does not comply with applicable law
  • Child sexual abuse material (CSAM)
  • Phishing pages, scam sites, or any content designed to fraudulently obtain personal information, credentials, or financial data
  • Threats, harassment, abuse, or defamation
  • Content promoting xenophobia, racism, or discrimination
  • Violent, misleading, fraudulent, or illegal content
  • Content that violates the privacy or legal rights of a third party
  • Malware, viruses, trojans, or similar harmful software
  • Pirated software or content promoting software piracy
  • Cryptocurrency mining or any other activity that consumes excessive server resources for purposes unrelated to the hosted service

Response to complaints. You must respond to any content or abuse complaint forwarded by TPC Hosting within 24 hours of notification. Failure to respond within this timeframe may result in suspension of the affected services without further notice.

Our rights. TPC Hosting is not obliged to monitor customer content. However, we reserve the right to:

  • Remove or modify content that violates these terms (with prior notice where practicable)
  • Suspend accounts that violate these provisions (without prior notice if necessary)
  • Immediately suspend or terminate services without prior notice in cases involving phishing, malware distribution, CSAM, or any activity that poses an imminent threat to the security or reputation of our infrastructure

Repeat offenders. If your account is involved in two or more confirmed content policy violations within a 12-month period, TPC Hosting reserves the right to terminate your account permanently.

Law enforcement cooperation. TPC Hosting cooperates with law enforcement authorities investigating illegal activity hosted on our infrastructure. We may disclose customer information, access logs, and hosted content in response to valid legal requests, court orders, or regulatory requirements. Where permitted by law, we will notify you before such disclosure.

Personal data. If you collect or process personal data through your hosted services, you are solely responsible for compliance with applicable data protection laws (see also Section 25).


20. Fair Use Policy

This policy protects the quality, performance, and stability of services for all customers. It applies to all service tiers — shared hosting, managed VPS, and self-managed VPS.

Shared Hosting Restrictions

The following restrictions apply specifically to shared hosting environments:

  • Continuously running background processes are not permitted
  • Cron jobs may not run at intervals shorter than 5 minutes
  • CGI scripts are not permitted

Resource usage. Shared hosting plans do not have published hard resource limits. However, TPC Hosting monitors CPU, memory, I/O, and database usage across all shared servers. If your usage noticeably degrades performance for other customers on the same server, TPC Hosting will contact you and may:

  • Request that you optimise your application or reduce resource consumption
  • Temporarily throttle or suspend the account to protect other customers
  • Recommend a VPS or higher-tier plan better suited to your workload

VPS Network Usage

VPS customers (managed and self-managed) are responsible for their own server administration but must not use TPC Hosting infrastructure for network abuse. The following are prohibited on all VPS plans:

  • Originating denial-of-service (DoS/DDoS) attacks or participating in botnets
  • Running open mail relays or open DNS resolvers
  • Conducting port scanning, whether inbound or outbound, against any system without the owner’s written permission
  • Generating outbound attack traffic (brute-force attempts, exploit probing, credential stuffing)
  • Operating public proxy servers or VPN exit nodes without prior written approval from TPC Hosting

TPC Hosting monitors network traffic patterns at the infrastructure level. If abusive outbound traffic is detected from your VPS, TPC Hosting may null-route or suspend the server immediately to protect the network.

Prohibited Activities (All Service Tiers)

The following activities are prohibited on all TPC Hosting services:

  • Creating or transmitting viruses, worms, or engaging in flooding, mail bombing, or denial-of-service attacks
  • Running IRC bots, torrent trackers, online game servers, or scripts with known security vulnerabilities
  • Operating web scraping infrastructure, credential-stuffing tools, or automated bot networks
  • Collecting personal information for unlawful purposes
  • Attempting unauthorised access to any system, network, or data (including port scanning, hacking, phishing, or spoofing) without the owner’s written permission
  • Interfering with services provided to other users (e.g., deliberate system overloading)
  • Forging TCP/IP packet headers
  • Uploading malicious, corrupted, or virus-infected files
  • Restricting or preventing other users from accessing TPC Hosting services
  • Harvesting email addresses or personal information without consent

Any activity that threatens server stability or network security is strictly prohibited and will be treated as abuse.

Enforcement

TPC Hosting follows a graduated enforcement process depending on the severity of the violation:

  1. Warning — for first-time or minor violations, TPC Hosting will notify you and request corrective action within 24 hours
  2. Suspension — if the violation is not resolved, or if the violation is severe (e.g., outbound attacks, phishing, malware), TPC Hosting may suspend the affected services immediately without prior notice
  3. Termination — repeated violations or a single severe incident may result in permanent account termination

TPC Hosting may immediately remove, block, or disable any account, application, or content that threatens the operation of our infrastructure or violates third-party rights — without prior notice if necessary.


21. Email Usage

Commercial emails may only be sent to recipients who have given their prior, explicit consent, in accordance with applicable law.

Email Authentication

You are responsible for configuring proper email authentication records (SPF, DKIM, and DMARC) for all domains used to send email through TPC Hosting infrastructure. TPC Hosting provides the tools and documentation to set these up, but configuration and ongoing maintenance are your responsibility. Failure to configure email authentication may result in poor deliverability, rejected messages, or IP reputation damage.

Mailing Lists and Newsletters

Email lists require verifiable, explicit consent from every subscriber. Records of consent must be retained for the lifetime of the list. All commercial mailings must:

  • Use double opt-in for subscription confirmation
  • Include a clearly visible unsubscribe mechanism in every message
  • Include the sender’s valid physical postal address or registered business address, as required by applicable law (including GDPR and the ePrivacy Directive)

Transactional vs. marketing email. Transactional emails (order confirmations, password resets, account notifications) are exempt from the consent and unsubscribe requirements above, but must not contain marketing content.

Best practices for bulk sending:

  • Schedule bulk sends for off-peak hours (before 09:00 or after 22:00)
  • Limit sending rate to no more than 50 emails per minute
  • Regularly clean your mailing lists to remove invalid, bounced, or unengaged addresses

Failure to follow these practices may result in email server congestion, IP blacklisting (affecting all customers on the same server), poor deliverability with providers like Gmail and Yahoo, or delayed/blocked email delivery.

TPC Hosting does not impose a hard per-hour email limit but actively monitors SMTP traffic. If sending volumes exceed what is appropriate for your hosting plan, we may intervene — including throttling outbound email or deleting queued messages without prior notice if blacklisting is imminent — and will contact you to discuss alternatives.

If you operate a mailing list, we recommend contacting us to establish sending best practices and determine whether a dedicated or upgraded plan would be more suitable.

Email limits:

  • Maximum attachment size: 30 MB
  • Maximum recipients per message: 25
  • For additional email services (e.g., Microsoft 365, Open-Xchange), refer to the respective product page for specific limits.

Avoid using large CC/BCC recipient lists. A single invalid address can cause the entire message to be held on the server.

TPC Hosting reserves the right to adjust email service parameters at any time to protect overall service quality. We encourage the use of dedicated email marketing platforms for bulk communications.


22. Anti-Spam Policy

Sending unsolicited commercial email (spam) — whether from our servers or from third-party servers to promote content hosted on TPC Hosting — will result in immediate suspension or termination of your account, without prior notice.

This includes spam sent through compromised applications (e.g., hacked CMS installations, vulnerable contact forms, or exploited scripts). You are responsible for keeping all applications on your hosting account secure and up to date. Spam originating from a compromised application on your account is treated identically to intentional spam.

Prohibited email practices. You may not use TPC Hosting services to send, transmit, or facilitate emails that:

  • Are unsolicited (spam) in violation of applicable law
  • Contain malware, phishing links, or other malicious content
  • Are sent to harvested, purchased, rented, or borrowed email lists
  • Are sent to incomplete, inaccurate, or unverified addresses
  • Use forged headers, non-existent sender domains, or misleading addressing
  • Obscure the origin of the transmission
  • Use a third party’s domain name or server without their consent
  • Contain false or deceptive information
  • Are likely to generate a high volume of spam complaints or result in IP blacklisting

Your obligations:

  • Respond to TPC Hosting’s spam-related inquiries within 24 hours of notification
  • Provide proof of subscriber consent upon request
  • Disclose your subscription and unsubscription methods upon request

Non-compliance may result in immediate account suspension.

IP blacklisting and remediation costs. On shared hosting, your email traffic shares an IP address with other customers. If your actions — including spam, misconfigured applications, or compromised scripts — cause a shared IP address to be blacklisted, you are liable for the costs incurred by TPC Hosting to delist the IP and mitigate the impact on other customers. Remediation is billed at €15.00/hour (minimum one hour).

Blacklist monitoring. TPC Hosting monitors the reputation of all IP addresses on its network daily. If an IP address is found on a blacklist, the following automated measures are applied immediately and without prior notice:

  • Outbound email traffic on port 25 (SMTP) is blocked at the firewall for the affected IP address
  • The customer associated with the IP is notified automatically by email

Email service is restored only after the underlying cause has been identified and resolved, and the IP has been delisted. Remediation assistance is available as described above.


23. Email Delivery

TPC Hosting cannot guarantee email delivery — whether inbound or outbound, internal or external to our network. Email delivery may be affected by factors including:

  • Full recipient mailboxes
  • Sender IP blacklisting
  • Mail server outages (sending or receiving end)
  • Network disruptions
  • Aggressive spam filters
  • Content flagged as spam by recipient or sender servers
  • Oversized attachments
  • Greylisting policies
  • Other external factors beyond our control

What TPC Hosting does. While delivery cannot be guaranteed, TPC Hosting takes active measures to maintain email reliability across its infrastructure, including daily IP reputation monitoring (see Section 22), server-level spam filtering, and proper reverse DNS configuration for all mail server IP addresses. On shared hosting, TPC Hosting maintains server-wide SPF records; domain-level authentication (SPF, DKIM, DMARC) remains your responsibility (see Section 21).

Critical communications. If your business depends on guaranteed email delivery, we recommend using a dedicated email service provider or a dedicated IP address (see Section 24) alongside properly configured email authentication.


24. Dedicated IP Addresses

Dedicated IPs are checked for blacklist status and reputation before assignment.

IP changes are granted only for well-founded reasons, particularly for IPv4 addresses, which are limited in the European allocation space (RIPE). TPC Hosting may assign IPv6 addresses, which function identically to IPv4.

If the reputation of your assigned IP has been degraded due to your actions, TPC Hosting may decline the change request or charge a fee equivalent to the IP allocation cost for the remaining hosting period.


25. Data Protection and Privacy

TPC Hosting processes personal data in accordance with the EU General Data Protection Regulation (GDPR — Regulation (EU) 2016/679) and applicable Romanian data protection law.

TPC Hosting may disclose customer information to comply with legal obligations, court orders, or regulatory requirements. Where permitted by law, we will notify you before such disclosure.

If you use TPC Hosting services to collect or process personal data of third parties, you act as an independent data controller (or, where applicable, a data processor) and are solely responsible for:

  • Obtaining a lawful basis for processing (e.g., consent, legitimate interest)
  • Providing appropriate privacy notices to data subjects
  • Implementing adequate technical and organisational security measures
  • Complying with all applicable data protection obligations

Where required, TPC Hosting will enter into a Data Processing Agreement (DPA) with you upon request.

Data breach notification. If TPC Hosting becomes aware of a security breach that affects customer data stored on our infrastructure, we will notify affected customers without undue delay via the email address on file. The notification will include, to the extent known at the time: the nature of the breach, the data potentially affected, the measures taken or proposed to address it, and recommendations for steps you may take to protect yourself or your end users. This obligation applies to breaches of infrastructure under TPC Hosting’s control and does not extend to breaches caused by customer-installed applications or customer-side security failures.


26. Intellectual Property

All content, materials, designs, and information on the TPC Hosting website are the exclusive property of TPC Management s.r.l. or its licensors.

You may not copy, reproduce, distribute, publicly display, or retransmit any part of our website content without prior written consent.

Your content. TPC Hosting does not claim any ownership rights over content, data, or applications that you upload, create, or store on our infrastructure. All intellectual property rights in your content remain yours (or your licensors’). By using our services, you grant TPC Hosting only the limited, technical permissions necessary to host, store, back up, and deliver your content as part of the service.


27. Service Modifications

TPC Hosting may modify, update, or discontinue services, features, or pricing at any time. We will provide reasonable notice of material changes:

  • Price increases will be communicated at least 30 days before they take effect and will not apply to active prepaid periods.
  • Service changes that materially affect your use will be notified via email or through your customer account.

You may terminate your contract if you do not agree with the changes, subject to the refund terms in Section 9.


28. Force Majeure

Neither party shall be liable for failure or delay in performing its obligations if such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications outages, cyberattacks, or failures of third-party providers.

The affected party must notify the other party promptly and make reasonable efforts to mitigate the impact. If the force majeure event continues for more than 60 days, either party may terminate the affected services.


29. Dispute Resolution and Governing Law

These Terms and Conditions are governed by the laws of Romania.

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails within 30 days, the dispute shall be submitted to the competent courts of Bucharest, Romania.

For consumers resident in the European Union: nothing in this section limits your rights under EU consumer protection law, including the right to bring proceedings in the courts of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.


30. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a competent court, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.


31. Amendments

TPC Hosting reserves the right to update these Terms and Conditions at any time. Material changes will be communicated via email or through your customer account at least 30 days before they take effect. This includes any amendments that affect pricing, service scope, liability, or customer obligations.

Continued use of our services after the effective date of any amendment constitutes your acceptance of the updated terms. If you do not agree with the changes, you may terminate your contract in accordance with the refund terms in Section 9.
